An attorney’s report alleges the abuse of small claims in trucking schools
A report by an attorney examining over 7,700 lawsuits brought against the Indianapolis-based trucking school, in only two Marion County small-claims courts. The reports alleges that systemic abuses led to thousands of judgements against individuals who might never have been in the area or state.
Jeffrey C. Boulden stated that he tried to gather as much information as possible to show there were real problems in the area. He gave copies of his report to Indiana Supreme Court justices as well as key judges and other media outlets.
Boulden said that Driver Solutions LLC had filed 7,711 lawsuits in Franklin- and Warren-township small claims courts between 2008, 2009, and April 30, 2012. These cases average 148 cases per months, more than six per business day. They are mainly filed against trainee drivers nationwide. There are several locations of the company.
Boulden looked at 25 percent and took a representative sample of cases. Boulden found that 93.3% of sample cases were being filed against defendants who live outside Indiana. Boulden asserts this is in violation of the Fair Debt Collections Practices Act (15 U.S.C. 1692i(a). This federal law regarding venue states that collection proceedings must be filed in the court where the contract was signed and where the consumer resides.
It also claimed that many defendants were wrongly served notice by U.S. Mail and that around 70% of judgements exceeded the $6,000.00 statutory limit on small claims. Boulden recommends that judgments of this nature should be null.
Indiana Court of Appeals Judge John Baker is among the judges who received a copy of Boulden’s examination of Driver Solutions LLC. Baker said that “it’s quite sad” following his first review of the unsolicited “The Poplicola Reporton the Marion County Small Claims Court” report. Baker was also part of the Supreme Court Task Force which issued its Report in May 2012. The report is titled, “The Poplicola Reporton the Marion County Small Claims Court” and addressed criticisms of abuses. Baker claims that legislators have not responded to Baker’s suggestions, such as incorporating the township courts into the Marion Superior Courts. Boulden’s Report, from that perspective, he stated, wasn’t surprising.
Baker explained that while this report may not have covered all of the time, it is possible to find some important changes in those times. However, Baker expressed frustration at the General Assembly’s lack of response.
